Family Court Fees Are Increasing from 1 April 2025.

If you are considering issuing court proceedings this year, be prepared for higher fees. The government has announced that, starting 1 April 2025, many court fees will increase.

Why are fees going up?

The government states that the increase will help improve court services and reduce the cost to taxpayers. The justice system has been struggling with delays, and the increased fees are meant to help improve staffing and resources.

How much more will you have to pay?

Here are some of the key fee increases that might affect families:

  • Divorce Applications – The cost of issuing divorce proceedings will rise from £593 to £612.
  • Child Arrangement Orders – If you need the court to decide where your child will live or how much time they will spend with each parent, the fee will increase from £255 to £263.
  • Financial Remedy Applications – If you’re asking the court to settle financial matters (such as dividing assets upon divorce), the fee will go up from £303 to £313.
  • Consent Applications – If both parties agree on a financial settlement and need the court to approve it, the fee will increase from £58 to £60.

What if you can’t afford the fees?

If you are on a low income or receiving benefits, you might not have to pay the full fee. The government has a Help with Fees scheme, which can reduce or waive court fees for those who qualify. You can check if you’re eligible and apply through the government’s website.

How will this affect families?

Some people worry that the rising costs will make it harder for families to access the court system. Going to court is often a last resort, especially when dealing with issues like child arrangements, divorce, or financial disputes.  There are often other alternatives, such as mediation, which are more cost effective and should be considered before court proceedings.
